Privacy Policy

POINT Technologies, LLC (“POINT,” “we,” “us,” or “our”) provides technology that helps organizations manage volunteers and helps people find and participate in volunteer opportunities.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use POINT, including pointapp.org, our mobile applications, dashboard, check-in kiosks, embeddable widgets, feeds, and other services we provide (collectively, the “Platform”).

This Privacy Policy should be read together with our Terms of Use.

1. Scope

This Privacy Policy applies to personal information POINT collects through the Platform and in connection with our services.

Organizations also use POINT to manage their own volunteer programs. When you volunteer with an organization, that organization may collect, access, and use information about you through POINT. The organization determines how it uses that information for its volunteer program and may have its own privacy practices or policies.

This Privacy Policy describes POINT’s practices. It does not govern how an organization independently uses information it receives about its volunteers outside of POINT.

2. Definitions

For purposes of this Privacy Policy:

“POINT,” “we,” “us,” and “our” mean POINT Technologies, LLC, an Ohio limited liability company.
“You,” “your,” and “user” mean any individual who uses the Platform.
“Volunteer” means an individual who uses POINT to discover, apply for, register for, participate in, or track volunteer activities.
“Organization” means a nonprofit, school, company, community organization, or other entity using POINT to organize or manage volunteer activities.
“Organization Administrator” means a person authorized to use POINT on behalf of an organization.
“Platform” means POINT’s websites, applications, dashboards, kiosks, widgets, feeds, and other services.
“Public Listing” and “Syndication Services” have the meanings provided in our Terms of Use.
“Personal information” means information that identifies, relates to, describes, or could reasonably be linked to an individual or household. The precise definition may vary under applicable law.

3. Changes to This Privacy Policy

We may update this Privacy Policy from time to time as our Platform, business, or legal obligations change.

When we make changes, we will post the updated Privacy Policy and revise the “Last Updated” date above. If we make material changes, we may provide additional notice, such as by email or through the Platform, where appropriate or required by law.

4. Information We Collect

The information we collect depends on how you interact with POINT and the features you use.

4.1 Information You Provide to Us

You may provide us with information such as:

name;
email address;
phone number;
date of birth or age;
mailing or residential address;
preferred volunteering location;
account credentials;
profile photo;
payment and billing information;
volunteer interests and preferences;
volunteer registrations, attendance, and hours;
application, questionnaire, or form responses;
documents or other materials you choose to upload;
emergency contact information;
dietary restrictions or other information requested by an organization;
communications with POINT or organizations using the Platform; and
other information you choose to provide.

Organizations may request additional information as part of their volunteer application, onboarding, qualification, or participation processes. Information you provide through an organization’s application, form, or questionnaire is made available to that organization.

If you provide information about another person, such as an emergency contact, you should have permission to provide that information and let that person know that you have done so.

4.2 Volunteer Activity and Attendance

When you register for or participate in volunteer activities, we may collect information about those activities, including registrations, applications, cancellations, check-ins, attendance, volunteer hours, and related records.

When you check in through POINT, including through a POINT check-in kiosk, we record your check-in and attendance information and make that information available to the organization hosting the volunteer activity.

We do not collect your device’s precise geographic location when you check in.

4.3 Information We Collect Automatically

When you use the Platform, we may automatically collect information such as:

IP address;
browser type;
device type;
operating system;
mobile network information;
pages and screens viewed;
links and buttons selected;
referring pages;
dates and times of activity;
login and account activity; and
information collected through cookies, software development kits, and similar technologies.

4.4 Location Information

When you use our mobile application, you may be asked to allow access to your approximate location—the general area you are in rather than your exact position.

We use approximate location to order address suggestions and help you find volunteer opportunities near a location you choose.

POINT does not collect your device’s precise geographic location.

You may decline location access and still search for and sign up for volunteer opportunities by entering a city, postal code, address, or other location or by using an address saved to your profile.

We do not collect your device location when you check in to a volunteer opportunity.

Your device’s coordinates are not stored in our records. Coordinates we maintain relate to venues and addresses entered by you or an organization.

4.5 Information From Other Sources

We may receive information from other sources when you direct or permit us to do so, including:

connected social media services;
calendar integrations;
organizations using POINT;
integrations you or an organization enable; and
other third-party services connected to the Platform.

5. How We Use Personal Information

We may use personal information for the following purposes.

5.1 Providing and Operating POINT

We use information to:

create and maintain accounts;
provide volunteer discovery, registration, application, and attendance features;
maintain volunteer records and hours;
enable organizations to manage their volunteer programs;
process transactions;
provide integrations requested by users or organizations;
provide customer support; and
otherwise operate the Platform.

5.2 Personalizing and Improving the Platform

We may use information to:

personalize your POINT experience;
understand how people use the Platform;
analyze trends and Platform performance;
troubleshoot problems;
improve existing products and features; and
develop new products and features.

5.3 Communicating With You

We may use information to send:

volunteer-related communications;
account and administrative messages;
technical notices;
security alerts;
payment or billing notices;
customer support communications;
product and feature updates; and
marketing communications where permitted by law.

You may unsubscribe from marketing emails using the unsubscribe instructions included in those communications. You may continue to receive transactional, service-related, or administrative communications necessary to operate your account or provide the Platform.

5.4 Security, Safety, and Legal Compliance

We may use information to:

protect accounts and the Platform;
prevent and detect fraud, misuse, and abuse;
investigate suspected violations of our Terms or policies;
enforce our agreements;
comply with legal obligations; and
protect the rights, safety, and property of POINT, our users, organizations, and others.

6. How We Disclose Personal Information

POINT does not sell volunteer personal information.

We may disclose personal information in the circumstances described below.

6.1 Organizations You Volunteer With

When you register, apply, check in, or otherwise interact with an organization through POINT, we make information associated with your volunteer relationship available to that organization.

Depending on the information collected and the POINT features the organization uses, authorized administrators may be able to access information such as:

your name and contact information;
date of birth;
address;
emergency contact information;
application and form responses;
volunteer registrations;
attendance and volunteer hours;
documents you submit;
qualifications or onboarding information; and
notes the organization’s authorized staff add to your volunteer record.

Organizations are responsible for their own use of information they access through POINT.

6.2 Information Visible Through the Platform

Certain information associated with an adult volunteer’s profile may be visible through the Platform depending on the feature being used and the volunteer’s applicable settings.

The name and profile photo of a volunteer under 18 are not shown publicly or to other volunteers. They remain visible to organizations with which that volunteer has registered or otherwise interacted.

6.3 Public Listings and Syndication

Organizations may create Public Listings for volunteer opportunities.

POINT may display those Public Listings outside the Platform through our Syndication Services, as described in our Terms of Use.

Volunteer personal information is not included in POINT’s Syndication Services.

6.4 Service Providers

We use companies that help us operate, maintain, and improve POINT. These providers may perform services such as:

cloud hosting and infrastructure;
payment processing;
email, text message, and push notification delivery;
customer support and communications;
analytics;
session recording;
product monitoring and error reporting;
mapping and address processing; and
other technical and operational services.

We require service providers to process personal information subject to contractual confidentiality and data-protection obligations appropriate to the services they provide.

6.5 Background Checks

Some organizations require volunteers to complete a background check.

Background checks are performed by a third-party consumer reporting agency, currently Checkr, Inc., under an agreement with the organization requesting the check.

To initiate a background check through the POINT integration, POINT transmits your email address to the provider so that it can send you an invitation and contact you directly. POINT does not transmit other information about you to the provider for purposes of initiating the check.

You provide the information necessary to complete the background check directly to the provider, and information you provide to that provider is governed by its own terms and privacy practices.

POINT does not receive, access, or store background check reports or their contents. POINT receives only the status of a check so that the organization can manage volunteer eligibility and assignments.

The background check report is available only to the organization that requested it—not to POINT or unrelated organizations using the Platform.

Background checks are most often requested for volunteers age 18 or older, but an organization may request a check for a volunteer under 18. Where required, consent from a parent or guardian is obtained directly by the background check provider, not POINT.

6.6 Organization-Enabled Integrations

Organizations may connect their POINT account with third-party systems they use, such as donor management or constituent relationship management (“CRM”) platforms.

When an organization enables an integration, POINT may transmit volunteer information from that organization’s POINT records to the connected service at the organization’s direction and for the organization’s use.

Depending on the integration, information transmitted may include:

name;
email address;
phone number;
date of birth;
address;
recorded volunteer hours; and
volunteer opportunity information.

The exact information transmitted varies by connected service.

POINT does not transmit internal staff notes, emergency contact information, or background check status or results through these integrations.

The organization selects the connected service, and its agreement with that provider governs how information is handled after transmission. POINT does not control the connected service.

If you want to know whether an organization has enabled an integration or how it uses information in its own systems, contact that organization directly.

6.7 Social Media and Other Third-Party Services

POINT may offer features that integrate with third-party services, including social media, calendars, or other services you choose to connect.

These features may allow information to be transmitted to or shared through those services. Information handled directly by a third-party service is subject to that service’s privacy policy and terms.

6.8 Legal and Safety Reasons

We may disclose information if we reasonably believe disclosure is necessary to:

comply with applicable law, regulation, subpoena, court order, or legal process;
respond to lawful government requests;
protect the rights, property, or safety of POINT or others;
investigate fraud, security incidents, or misuse; or
enforce our Terms of Use, Authorized Use Policy, Community Guidelines, or other agreements.

6.9 Business Transactions

If POINT or the Platform is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law.

We may also disclose information in connection with due diligence for a potential transaction.

6.10 At Your Direction or With Your Consent

We may disclose information when you direct us to do so, consent to the disclosure, or intentionally use a feature designed to disclose information to another party.

6.11 Aggregated and De-Identified Information

We may use and disclose aggregated or de-identified information that cannot reasonably be used to identify you.

Where required by applicable law, we will maintain and use de-identified information in de-identified form and will not attempt to re-identify it except as permitted by law.

7. Cookies, Analytics, and Similar Technologies

We use cookies, software development kits, and similar technologies to operate the Platform, understand how it is used, diagnose problems, communicate with users, protect the Platform, and improve our products.

These technologies may collect information such as:

IP address;
browser and device information;
operating system;
pages and screens viewed;
links and buttons selected;
referring pages; and
dates and times of activity.

We may work with providers of website and product analytics, session recording, error monitoring, live chat, customer relationship management, marketing, and communications services.

When you are signed in, we may provide an account identifier or email address to certain product analytics or session-recording providers so that we can understand how authenticated users experience the Platform.

Session-recording technology may capture interactions such as mouse movement, clicks, and navigation. We configure session recording to mask text entered into form fields.

You can control certain cookies through your browser settings. If you block cookies, some Platform features may not function properly.

7.1 Advertising and Conversion Measurement

Our public marketing website may use technologies that help us understand marketing performance, measure conversions, or advertise POINT.

Certain uses of advertising technologies may be considered a “sale” or “sharing” of personal information under some privacy laws even when no money changes hands.

We do not use advertising technologies for cross-context behavioral advertising within the POINT dashboard or other authenticated portions of the Platform.

Where applicable law gives you the right to opt out of a sale, sharing, or targeted or cross-context behavioral advertising, we honor those rights as described in Section 11.

7.2 Tools Added by Organizations

An organization may add or link to third-party tools of its own choosing, such as fundraising or donation tools, on pages it controls within or linked from the Platform.

Those tools are provided by the third party selected by the organization. The third party’s own privacy policy governs information it collects directly, and POINT does not control those tools.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected or otherwise processed, including to:

provide and maintain the Platform;
maintain accounts and volunteer records;
support organizations using POINT;
complete transactions;
comply with legal, tax, accounting, and reporting obligations;
maintain security and prevent fraud and abuse;
resolve disputes; and
enforce our agreements and legal rights.

The period for which we retain particular information depends on factors including:

the type and sensitivity of the information;
the purpose for which it was collected;
how long your account or an organization’s account remains active;
whether information forms part of an organization’s volunteer records;
applicable contractual requirements;
security and fraud-prevention needs; and
applicable legal, regulatory, tax, accounting, or reporting requirements.

When personal information is no longer reasonably necessary for these purposes, we may delete, anonymize, or de-identify it in accordance with our retention practices.

Information may remain for a limited period in backups, archives, or other systems after deletion from active systems.

9. Security

We maintain administrative, technical, and organizational measures designed to protect personal information against unauthorized access, acquisition, loss, misuse, alteration, or disclosure.

No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security.

10. Your Account

You may review or update certain account information through your POINT account settings.

You may deactivate your account through available account settings or by contacting us at support@pointapp.org.

Deactivating your account does not necessarily delete all information associated with it. We may retain information as described in Section 8, including information maintained as part of an organization’s volunteer records or information we are required or permitted to retain.

11. Your Privacy Choices and Rights

Depending on where you live and applicable law, you may have certain rights regarding your personal information.

These rights may include the right to:

request access to or information about personal information we maintain about you;
request correction of inaccurate personal information;
request deletion of personal information;
receive a portable copy of certain personal information;
opt out of certain sales, sharing, targeted advertising, or other processing;
limit certain uses or disclosures of sensitive personal information where applicable;
withdraw consent where processing is based on consent; and
exercise privacy rights without unlawful discrimination or retaliation.

These rights are subject to applicable exceptions and limitations.

We may need to verify your identity before fulfilling a request. The information needed for verification will depend on the nature of the request and the information involved.

Where permitted by law, an authorized agent may submit a request on your behalf. We may require evidence that you authorized the agent to act for you and may separately verify your identity.

If POINT processes information on behalf of an organization and the organization is responsible for responding to your request, we may direct you to that organization or assist the organization in responding as appropriate.

11.2 Opt-Out Preference Signals

Where required by applicable law, POINT recognizes qualifying browser-based opt-out preference signals, including Global Privacy Control (“GPC”), as a request to opt out of the sale or sharing of personal information associated with the browser or device sending the signal.

Where required and technically feasible, if you are signed in and we can reasonably associate the signal with your account, we will apply the request to your account as required by applicable law.

12. Additional Information for California Residents

This section provides additional information for California residents.

To the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), applies to POINT’s processing of your personal information, California law may provide the rights described below.

12.1 Categories of Personal Information

Depending on how you interact with POINT, we may collect the following categories of personal information:

We do not necessarily collect every example listed above from every user.

We collect, use, and disclose these categories for the purposes described elsewhere in this Privacy Policy.

12.2 Sale and Sharing of Personal Information

POINT does not sell volunteer personal information.

Volunteer personal information is not included in POINT’s Syndication Services, and Public Listings do not include volunteers’ personal contact information.

Our public marketing website may use advertising or conversion-measurement technologies. Depending on how those technologies operate, disclosures made through them may constitute “sharing” of identifiers or internet or electronic activity information for cross-context behavioral advertising under California law.

Where the CCPA applies and POINT engages in activity that constitutes selling or sharing, California residents may exercise the applicable right to opt out as described in Section 11.

POINT does not use these advertising technologies for cross-context behavioral advertising within the POINT dashboard or other authenticated portions of the Platform.

12.3 California Privacy Rights

Where applicable, California residents may have the right to:

Know and Access. Request information regarding the personal information POINT has collected, including categories of information, sources, purposes, categories of recipients, and specific pieces of personal information.
Delete. Request deletion of personal information POINT collected from you, subject to applicable exceptions.
Correct. Request correction of inaccurate personal information maintained by POINT.
Opt Out of Sale or Sharing. Direct POINT not to sell or share personal information for cross-context behavioral advertising where POINT engages in such activity and the right applies.
Limit Certain Uses of Sensitive Personal Information. Where POINT uses or discloses sensitive personal information in a manner that gives rise to this right under California law, request that POINT limit such use or disclosure.
Non-Discrimination and Non-Retaliation. Exercise applicable CCPA rights without receiving discriminatory treatment or retaliation prohibited by law.

You may submit an applicable request using the methods described in Section 11.

12.4 Opt-Out Preference Signals

Where required under California law, POINT processes qualifying opt-out preference signals, such as Global Privacy Control, as requests to opt out of the sale or sharing of personal information.

This is separate from a browser’s traditional “Do Not Track” setting.

12.5 Do Not Track

Some browsers offer a “Do Not Track” (“DNT”) setting.

There is not currently a generally accepted industry standard for interpreting DNT signals, and POINT does not respond to traditional DNT signals.

This does not affect our treatment of legally recognized opt-out preference signals such as Global Privacy Control where applicable law requires us to recognize them.

12.6 Direct Marketing

POINT does not disclose personal information to third parties for those third parties’ own direct marketing purposes in a manner that would require disclosure under California’s “Shine the Light” law.

13. Volunteers Under 18

POINT provides additional privacy protections for younger volunteers.

The name and profile photo of a volunteer under 18 are not displayed publicly or to other volunteers. Organizations with which the volunteer registers or interacts may still access information necessary to administer their volunteer programs, including information in the volunteer’s record with that organization.

POINT does not collect precise device geolocation from volunteers, including volunteers under 18.

If you are under 18, we also provide separate Privacy Information for Younger Volunteers explaining our practices in plain language.

13.1 California Users Under 18

If you are a registered POINT user under 18 and reside in California, you may request removal of content posted publicly through the Platform.

To make a request, email support@pointapp.org from the email address associated with your account and identify the content you would like removed.

We will remove or anonymize eligible content as required by applicable law.

Removal may not ensure complete deletion in every circumstance. For example, information may remain in backups for a limited period, may be retained where permitted or required by law, or may have been independently copied or reposted by another person.

14. Background Checks and Other Third-Party Services

When you use a third-party service through or in connection with POINT, that service may collect information directly from you.

Information you provide directly to a third party is governed by that party’s privacy policy and terms. We encourage you to review those policies before providing information.

Nothing in this Privacy Policy changes the rights or obligations that may apply to organizations or background check providers under the Fair Credit Reporting Act or other applicable laws.

Terms of Use

By using the POINT Platforms, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms of Use”, “Terms and Conditions” or “Terms”).

The Terms of Use is an agreement you must accept in order to use POINT’s services. Any violation of the Terms of Use may result in a termination or suspension of your account. Your use of the Platform signifies that you agree to the Terms of Use. If you are using the Platform for an organization, you represent that you have authority to bind that organization, and you agree to the Terms of Use on its behalf. If you do not agree or are unable to agree to the Terms, then use of the Platform is strictly prohibited.

1. Agreement

These Terms of Use are entered into between POINT Technologies, LLC (“POINT” or “Company”) and you. POINT provides a platform that enables organizations and volunteers to connect. POINT does not organize, operate, or control events hosted by organizations.

These Terms govern all use of POINT’s Platforms, including

a. PointApp.org (“website” or “Site”)
b. POINT mobile applications (“app” or “apps”)
c. POINT dashboard (“dashboard” or “Dashboard”)
d. the POINT check-in kiosk feature (“kiosk”), which is a web-based feature accessed through a URL provided by POINT. POINT does not provide or control the physical device used to access the kiosk. Organizations are responsible for providing, maintaining, and controlling any device used to access the kiosk.
e. the Syndication Services described in Section 6.h, including embeddable widgets and RSS feeds.

2. Definitions

For purposes of these Terms:

a. “POINT,” “Company,” “we,” “us,” and “our” mean POINT Technologies, LLC, an Ohio limited liability company.
b. “You”, “your,” “user”, “volunteer” and “member” to mean any person using our Platform, and “organizers”, “companies”, “schools”, “event sponsors”, “event organizers”, “organization administrator”, “volunteer administrator”, “event leader”, “nonprofit administrators”, or “nonprofit organizers” to mean any organization or person using the Platform on an organization’s behalf. Organizations can include nonprofits, schools, universities, community organizations, local governments and companies.
c. “Platform(s)” mean any website, widget, application, dashboard, kiosk, feed, or service offered by POINT including content we offer and electronic communications we send.
d. “Public Opportunity” means an event or volunteer opportunity that an organization has designated as public. “Private Opportunity” means one that an organization has designated as private.
e. “Public Listing” means the non-personal information in a Public Opportunity, including its title, description, cause area, date and time, location, requirements, and the organization’s name, public description, and a role-based or organizational contact address the organization designates for public display. A Public Listing does not include volunteer personal information, and does not include the name or personal contact details of any individual.
f. “Syndication Services” means the widgets, application programming interfaces (APIs), RSS feeds, and other tools and channels through which POINT makes Public Listings available for display outside the Platform.

3. Revisions

We may update and change these Terms of Use from time to time. If we make a material change, we will provide notice by posting the updated Terms on the Platform with a revised “Last Updated” date and, where we have your email address, by email or through the platform. Any new features that modify, augment or enhance the Platform shall be subject to the Terms of Use. Continued use of the Platform after any such change constitutes consent to and acceptance of the Terms of Use regarding such change.

4. Your Account and Membership

a. Summary

Use of the POINT Platforms may require creating an online account. The account must be created as accurately as possible. You are solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your password secure. Volunteers must be at least 13 years old. Charity organizers control the Content and enforce the minimum age requirement of the events. We reserve the right to remove any Content you post and may terminate your account at any time.

b. Account Creation

You must be a human in order to use the Platform. Accounts may not be registered by “bots” or other automated means. To complete the registration process, you must provide your full legal name, a valid e-mail address and any other information requested by the Platform. You are the only person permitted to use your login and a single personal login may not be shared by multiple people (this excludes charity accounts which can be run by more than one administrator). By using the Platform you agree to (i) provide true, accurate, current and complete information about yourself as requested by the Platform and (ii) maintain and promptly update such information to keep it true, accurate, current and complete. If you provide information that is false, inaccurate, outdated or incomplete, or POINT has reasonable grounds to suspect that such information is false, inaccurate, outdated or incomplete, we reserve the right to suspend or terminate your access to the Platform and prohibit your future use of the Platform.

c. Eligibility

Our Platform is available to anyone who is at least 13 years old. By creating an account, you verify that you are at least 13 years of age. Additional eligibility requirements for a particular portion of our Platform may be set by any member who has the ability to moderate or manage that portion of our Platform. For example, the eligibility requirements for an event may be set by the organizers of that event. By registering for an event, you agree that you meet the eligibility requirements set forth by the organizers. If you are found to be in violation of these eligibility requirements, we reserve the right to suspend or terminate your account.

d. Suspension of Your Account

We may modify, suspend or terminate your account or access to the Platform if, in our reasonable discretion, we determine that you have violated these Terms (including any of the policies or guidelines that are referenced within these Terms), it is in the best interest of the POINT community or to protect our users, brand and Platform. This applies to conduct on the Platform and to conduct in connection with a volunteer opportunity or other activity arranged through the Platform, including conduct occurring in person or otherwise off the Platform. This Section reserves a right and does not create a duty: POINT has no obligation to monitor conduct occurring off the Platform, and nothing in this Section obligates POINT to organize, operate, supervise, or control any volunteer opportunity or activity nor limits Section 7.d.

We may take immediate action where the issue involves:

a risk to the safety of a person;
a security or privacy risk;
a legal obligation, court order, or law enforcement request;
fraud, misappropriation, or unlawful conduct;
threats, harassment, abuse, or other harmful conduct directed toward POINT personnel, users, or organizations; or
other conduct we reasonably determine requires immediate action.

We will notify you of a suspension or termination and the general reason for it, unless we are prohibited from doing so by law or legal process, or unless we reasonably believe that providing notice would create a risk to the safety or security of any person, the Platform, or an investigation.

Before suspending or terminating an organization’s account for a violation that is capable of being corrected, we will provide notice and a reasonable opportunity to correct the violation, except where the violation involves (i) a risk to the safety of any person, (ii) a security risk to the Platform or its users, (iii) a legal obligation, court order, or law enforcement request, (iv) fraud or misappropriation, or (v) conduct that we reasonably determine requires immediate action. For accounts other than organization accounts, we may provide an opportunity to correct a violation but are not required to do so. If you believe your account was suspended or terminated in error, you may contact us at support@pointapp.org. POINT may also deactivate or remove accounts that have been inactive for an extended period, subject to our applicable data retention practices.

e. Organizer-Level Suspension

An organization administrator may, at their sole discretion, modify, suspend, or terminate a user’s access to that organization’s opportunities, profile or specific portion of the Platform. This may include, but is not limited to, situations in which an event organizer can suspend access to a user’s ability to register for events they post, based on past violations of that charity’s volunteer guidelines. These decisions are made by the organization and not by POINT. To protect the safety and privacy of organizations, their staff, and other volunteers, POINT does not notify a user when an organization limits or removes that user’s access to the organization’s events, and the notice commitment in Section 4.d does not apply to actions taken by an organization under this Section 4.e. Questions about an organization’s decision should be directed to that organization.

f. Termination

The Company reserves the right to terminate your account for violation of the Terms of Use. Verbal, physical, written or other abuse, including, but not limited to, threats of abuse or retribution, of any Company employee, officer or agent employed by or acting on behalf of Company may result in immediate account termination. Notice of a termination will be provided in accordance with Section 4.d, and where appropriate we may provide an opportunity to correct violations.

g. Account Information and Security

When you register, you provide POINT with some basic information, including an email address and a password. You are responsible for keeping your email address, password, and other account information current and accurate. You are responsible for anything that happens from your failure to maintain that security and confidentiality, such as by sharing your account credentials with others. If an unauthorized person has gained access to your account, or you suspect that this may have occurred, notify us immediately. Company cannot and will not be liable for any loss or damage from your failure to comply with security obligations.

h. User Content and Responsibility

All organizations and organization administration are responsible for Content posted by or on behalf of your organization and for harm resulting from that Content. This includes content of any form such as event listings and any accompanying text, photo, video, and audio recordings. We reserve the right to take down any Content that we feel violates our Community Guidelines and reserve the right to discontinue the membership of anyone who continually posts harmful Content. Organizations are also responsible for responding to support questions, comments, and complaints directed to your organization. Organizations should provide appropriate contact information so volunteers can contact them regarding their programs, requirements, privacy practices, or concerns.

5. Fees, Payments, and Offers

a. Summary

We charge for certain features on our Platform. If you are an organization administrator, you are responsible for paying for your organization’s subscription fees and ensuring payment information is up-to-date. These fees are billed on a regular and recurring basis (unless you disable auto-renewal or cancel your subscription). POINT may change our fees and pricing in the future. We will give users advance notice if this occurs. Some organizers may charge money for participation in a certain event, or require fundraising in order to participate, and we leave this decision at their sole discretion. Organization subscriptions are non-transferable.

b. Fees Charged by POINT

Some features of our Platforms are free, while others are only available for a fee. Downloading the app will always be free. However, some features such as those used by event organizers may be available only through paid subscription. We reserve the right to add or modify any fees at any time for certain current or future features of our Platform. If we implement a new or modified fee, we will give you advanced notice by posting changes on our Platform or sending you an email. You agree to pay those fees and any associated taxes for your continued use of the applicable service. Unless otherwise stated, all fees and all transactions are in U.S. dollars. All fees are exclusive of applicable federal, state, local, or other taxes. Organization subscriptions are non-transferable.

c. Fees Charged by Organizers

Organizers may charge fees associated with certain aspects of events posted on the Platform. These may include fees for event supplies or materials, additional training, donations or fundraising requirements in order to participate. The decision to charge fees and the amount of those fees is at the discretion of those organizers. Any and all payments by users to organizers must be made through a separate platform. POINT does not accept any responsibility or liability for such payments, does not process, hold, escrow, or refund such payments, and is not authorized to do so.

d. Subscription Fees

Organizers are responsible for paying subscriptions and any other applicable fees to POINT on time and through our approved payment methods. POINT offers different fee structures and levels of service. By signing up for a particular level of service, you agree to pay POINT the applicable subscription fees. Unless you notify us before the end of your subscription period that you no longer wish to have an account on our Platform, your subscription will renew automatically. If we change pricing for a service to which you are subscribed, we will notify you before your subscription is set to renew. You may upgrade or downgrade your subscription tier at any time through your dashboard. To cancel your subscription, contact us at support@pointapp.org before the end of your then-current subscription period.

e. Removal of Non-paying Accounts

If the subscription payment fails or has been cancelled for multiple months, POINT may remove your account, all information and content associated with the account, and all events associated with the account. If we terminate, suspend, or remove your account in connection with violation of these Terms, we are not obligated to refund any organizer subscription fees paid to POINT.

f. Payment Methods

You may only pay fees to POINT using a valid payment method acceptable to us, as specified via the Platform. You represent and warrant that you are authorized to use the payment method you designate via the Platform. You authorize us (and our designated third-party payment processors) to charge your designated payment method for the total amount of any fees you owe to POINT, including any applicable taxes and other charges. Your payment may be suspended or cancelled if the payment method cannot be verified, is invalid, or is otherwise not acceptable to us. We reserve the right to correct, or to instruct our payment processors to correct, any errors or mistakes, even if payment has already been requested or received.

g. Automatic Subscriptions

Fees for certain aspects of our Platform are invoiced on a recurring basis. Fees must be paid in advance of the applicable period specified via the Platform, or invoiced automatically every 30 days. If invoiced automatically, we will invoice you for each renewal period on a consistent day each month until cancellation. By purchasing any feature or other aspect of our Platform for which we charge, you authorize us to keep your payment current by charging your credit card account (or any other means of payment used by you) the applicable fee.

h. Refund Policy

We are unable to grant prorated or partial refunds. If you cancel your account prior to the end of your selected invoicing period, you will continue to have access to your account until your invoicing period ends. In the event that you intended to cancel your account but forgot to do so prior to the start of a new invoicing period, and you have not used the Platform during the new invoicing period, please contact us at support@pointapp.org and we will assist you. We understand that there might be extenuating circumstances. Whatever it is, reach out to us at support@pointapp.org and we’ll do our best to make it right.

6. Content, Privacy and Optional Features

a. Summary and Intended Use

POINT is not responsible for user content posted on our Platform, and views expressed by users are not necessarily those of POINT. Users and organizers are solely responsible for the Content they post on the Platform.

By posting Content on POINT, you grant POINT a license to use such Content for purposes including operating, improving, protecting, promoting, and distributing the Platform, in a manner consistent with these Terms and our Privacy Policy. Any use of Content for promotional or illustrative purposes is limited to non-sensitive, high-level information and is intended only to describe or demonstrate how the Platform is used.

POINT will not use Sensitive Information in promotional materials. “Sensitive Information” includes, but is not limited to, physical addresses, background check data, information involving minors, or other non-public personal or event-specific information that could reasonably be considered private or sensitive. This does not restrict the display or distribution of information that an organization has designated for public display as part of a Public Listing.

POINT collects, uses, and displays Content and personal information to operate, support, and improve the Platform, to facilitate connections between organizations and volunteers, to make Public Listings available through the Syndication Services described in Section 6.g, and to communicate about events, features, and services. POINT does not use Content or information in ways that would reasonably be unexpected by users or inconsistent with these Terms and our Privacy Policy.

Our Privacy Policy explains how we collect, use, and share personal information and should be reviewed for additional details.

b. Your Content

You are solely responsible for your Content. We use the word “Content” to mean any information, material, or other content posted to our Platform or otherwise provided to us (such as feedback, comments, or suggestions shared with us). You agree that you and your Content shall not violate the rights of any third party (such as copyrights, trademarks, contract rights, privacy rights, or publicity rights) or these Terms, including our Community Guidelines and Privacy Policy.

c. Legality

By using our Platform, you also agree that any Content posted on the Platform complies with any applicable laws or regulations. Remember that most, if not all, Content posted on POINT is public, which means that you should use your best judgment when setting up your events, running events, posting Content, and recruiting volunteers/ registering as a volunteer. This may mean that you choose to share or not to share specific addresses, contact information, or names in the public feed on the Platform.

d. Content Ownership

POINT does not claim ownership of your Content. However, to enable us to operate, improve, promote, protect, and distribute POINT and our Platform, and to ensure we do not violate any rights you may have in your Content, by using POINT you grant POINT a non-exclusive, worldwide, royalty-free, sublicensable, transferable right and license (including a waiver of any moral rights) to use, host, store, reproduce, modify, adapt, publish, translate, publicly display, publicly perform, distribute, and create derivative works of your Content, in each case for the purposes described in Sections 6.a and 6.g. This license continues for so long as your Content remains on the Platform and, with respect to Public Listings already made available through the Syndication Services, for a reasonable period thereafter sufficient to allow recipients to update their records. It also continues for a reasonable period to the extent necessary for backup, archival, legal, or dispute-resolution purposes.

You are solely responsible for Content you provide.

You agree that your Content will not:

violate the rights of another person or organization;
infringe copyrights, trademarks, privacy rights, publicity rights, contractual rights, or other legal rights;
violate applicable law; or
violate these Terms, our Community Guidelines, or our Authorized Use Policy.

e. Privacy

When you engage with our Platform, you entrust us with certain personal information. POINT collects and uses this information only as necessary to operate the Platform and to facilitate your participation in volunteer activities.

Some organizations using the Platform may require additional steps—such as background checks or inclusion in a volunteer database—as a condition of participation in specific events or activities. These requirements are determined solely by the organization hosting the event, not by POINT. Background checks are optional and are conducted only when all of the following apply: (i) the organization requires a background check for a specific event or role, (ii) you are clearly informed of this requirement in advance, and (iii) you provide your authorization or explicit consent required by applicable law directly to Checkr, or to the organization’s other chosen provider, to run the background check the requesting organization ordered.

The organization requesting a background check is responsible for providing any disclosures and obtaining any authorizations, consents, and acknowledgments required by applicable law in connection with that check, including under the federal Fair Credit Reporting Act and any applicable state law. POINT does not provide those disclosures and does not obtain those authorizations on any organization’s behalf.

POINT offers an optional integration with Checkr, Inc. (“Checkr”), a third-party consumer reporting agency. Where an organization uses this integration, that organization maintains its own agreement directly with Checkr, and Checkr performs the background check under its own terms, policies, and applicable laws. POINT does not conduct background checks and is not a consumer reporting agency. An organization may also use a provider outside the Platform, in which case POINT is not involved. POINT does not receive, access, or store background check reports or their contents. Through the integration, POINT receives and displays only the status of a background check. For example, statuses include “pending”, “complete”, or “eligible” so that the organization can manage volunteer assignments. The report itself is available only to the organization and to you. To initiate a check, POINT transmits your email address to Checkr so that Checkr can contact you directly; POINT does not send Checkr any other information about you.

POINT does not sell your personal information. For more information about how we collect, use, and disclose personal information, please review our Privacy Policy. Please note that POINT does not control personal information that you choose to share directly with organizations or other users through the Platform, and we disclaim responsibility for how such parties may use that information. If you believe an organization is using the Platform to unlawfully or unethically collect, use, or distribute your information, please contact us immediately at support@pointapp.org.

f. Organization Use of Volunteer Personal Information

If you are an organization, organization administrator, or any person acting on behalf of an organization to access personal information about a volunteer through POINT, you are responsible for your collection, access, use, disclosure, retention, and protection of that information and agree to handle it in accordance with these Terms and applicable law.

Permitted Use

Organizations may use personal information obtained through POINT only for legitimate purposes related to:

your volunteer program;
managing your organization’s relationship with the volunteer;
administering applications, onboarding, qualifications, scheduling, attendance, communications, recognition, or similar volunteer functions;
maintaining appropriate organizational records;
protecting the safety or security of volunteers, staff, or your organization;
complying with applicable law; or
another purpose the volunteer reasonably expects in connection with their relationship with your organization.

Organizations may not use personal information obtained through POINT for purposes that are materially unrelated to your legitimate relationship with the volunteer.

Data Minimization

Organizations agree to collect and request only personal information that is reasonably necessary and appropriate for your volunteer program or another legitimate organizational purpose. You may not use POINT to solicit unnecessary sensitive information from volunteers.

Prohibited Uses

Organizations may not:

sell volunteer personal information;
act as a data broker with respect to volunteer personal information obtained through POINT;
use volunteer personal information for unrelated third-party advertising;
use volunteer personal information for unrelated commercial solicitation;
compile or disclose volunteer information for purposes unrelated to your organization’s legitimate relationship with the volunteer;
access personal information without a legitimate organizational need; or
use personal information in a manner that violates applicable privacy, consumer protection, anti-discrimination, or other laws.

Access Controls and Security

Organizations agree to maintain reasonable administrative, technical, and organizational safeguards appropriate to the nature and sensitivity of the personal information you access through POINT. Organizations must limit access to volunteer personal information to employees, contractors, representatives, and service providers who reasonably need the information for authorized organizational purposes. Organizations are responsible for managing administrator permissions within your organization and promptly removing access when it is no longer appropriate.

Sharing With Service Providers and Other Third Parties

Organizations may provide volunteer personal information to a service provider or other third party only where the disclosure is:

reasonably necessary for a legitimate organizational purpose;
made at the volunteer’s direction or with appropriate authorization;
necessary to provide a service requested by the volunteer;
subject to appropriate confidentiality and data-protection obligations where applicable; or
required or permitted by law.

Organizations remain responsible for your organization’s disclosure or export of volunteer personal information to another system or service and for ensuring that any service providers acting on your organization’s behalf handle that information in accordance with applicable law and any obligations applicable to your organization.

Integrations and Exports

When Organizations enable a third-party integration, export information from POINT, download reports, copy information into another system, or otherwise transfer information outside POINT, your organization is responsible for the subsequent storage, access, use, disclosure, retention, and security of that information.

POINT does not control an organization’s independent use of personal information after the information has been exported or transmitted to a service selected by the organization.

Privacy Notices, Consents, and Rights

Organizations are responsible for providing any privacy notices and obtaining any consents, authorizations, or acknowledgments required by applicable law for the organization’s collection and use of volunteer personal information. Organizations are also responsible for responding to applicable privacy requests concerning personal information under their control. POINT may reasonably assist organizations with requests relating to information maintained within the Platform where required by applicable law or an applicable agreement.

Security Incidents

If an organization becomes aware of unauthorized access to, acquisition of, use of, or disclosure of personal information obtained through POINT, the organization must promptly take reasonable steps to investigate, contain, and remediate the incident and comply with its obligations under applicable data security and breach-notification laws.

The organization must promptly notify POINT at support@pointapp.org if the incident:

involves the POINT Platform or an organization’s POINT account;
may compromise POINT credentials or systems;
may affect other POINT users or organizations; or
otherwise reasonably requires POINT’s involvement in investigation, mitigation, or notification.

Each party remains responsible for any notification or other obligations imposed on it by applicable law.

Enforcement

POINT may investigate reports of misuse of volunteer personal information. POINT may restrict, suspend, or terminate an organization’s access to personal information or the Platform if we reasonably believe the organization has collected, accessed, used, disclosed, or failed to protect personal information in violation of these Terms, applicable law, or the rights of a user. If you believe an organization is improperly collecting, accessing, using, or disclosing information obtained through POINT, contact support@pointapp.org.

g. Optional AI Features

Use of optional artificial intelligence features on the Platform is governed by the POINT AI Features Terms of Use, which apply only if an organization or user chooses to enable or use such features.

h. Syndication Services

(1) What we offer.

Volunteer recruitment works best when opportunities are easy to find. POINT offers Syndication Services that make Public Listings available for display outside the Platform, so that organizations reach volunteers who may never visit POINT directly. These include embeddable widgets, APIs, and RSS feeds, and may include other formats and channels we introduce from time to time.

(2) Distribution by POINT.

POINT may distribute, syndicate, sublicense, and otherwise make available Public Listings to third-party websites, applications, and partners through the Syndication Services, and may charge those third parties for access. Public Listings may therefore appear outside the Platform, for example, on partner websites and applications, community volunteer hubs, corporate social responsibility portals, campus volunteering pages, donation and fundraising platforms that present volunteer opportunities alongside ways to give, and in search engines and other indexes.

(3) Use of the Syndication Services by organizations and partners.

Subject to these Terms and to any documentation, usage limits, or API terms we publish: (i) an organization may use the Syndication Services to display its own events and volunteer opportunities, including Private Opportunities, on websites and applications it controls; and (ii) an organization, company, school, donation or fundraising platform, or other authorized party may use the Syndication Services to display Public Listings posted by other organizations. Public Listings displayed under (ii) remain the Content of the organization that posted them, and the party displaying them must meet the obligations in Section 6.h(5).

(4) No personal information.

POINT does not include volunteer personal information in the Syndication Services and does not include the name or personal contact details of any individual. Except where an organization uses the embeddable widgets to display its own Private Opportunities, as described in Section 6.h(3)(i), POINT makes only Public Listings available through the Syndication Services.

(5) Recipient obligations.

POINT requires recipients of Public Listings, by contract or by the terms applicable to the relevant Syndication Service, to display Public Listings accurately and without material alteration, to use them only to connect volunteers with organizations, and not to resell or redistribute them except as POINT expressly permits in writing. Recipients are not agents of POINT, and POINT is not responsible for their websites, applications, or conduct.

(6) Public and private opportunities.

Organizations control distribution through the visibility setting on each event or volunteer opportunity. When an organization designates an opportunity as public, its Public Listing is made available through the Syndication Services and may be displayed outside the Platform as described above. When an organization designates an opportunity as private, it is not made available through the Syndication Services and POINT does not distribute it to any third party; the organization may still display a Private Opportunity through its own widget or feed under Section 6.h(3)(i), in which case the organization controls where it appears. An organization may change an opportunity from public to private at any time through its dashboard, which removes the corresponding Public Listing from the Syndication Services, subject to Section 6.h(7).

(7) Removal and updates.

When an organization removes an opportunity, edits it, or changes it from public to private, POINT will make the corresponding change available through the Syndication Services. POINT does not control how quickly a recipient updates its own display, and a Public Listing may remain visible on a third-party site for a period after the change.

(8) No guarantee.

POINT does not guarantee that any Public Listing will be displayed by any third party, or the manner, prominence, or duration of any display. POINT may modify, limit, or discontinue any Syndication Service at any time.

7. Your Use of Our Platform

a. Summary

We require that you follow our policies and guidelines when using our Platform. All Content posted on the Platform must follow our Community Guidelines.

b. POINT Policies

By using the Platform you agree to our Terms, Privacy Policy, Community Guidelines and Authorized Use Policy. You agree to comply with all applicable laws, rules and regulations, and to not violate or infringe the rights of any third party. If you do not comply, we may temporarily suspend or permanently block your account or access to the Platform in accordance with Section 4.d.

c. Content of Others

POINT does not control the Content of other members. When we become aware of inappropriate Content on our Platform, we reserve the right to investigate and take appropriate action, but we do not have any obligation to monitor, nor do we take responsibility for, the Content of other members.

d. Interactions with Others

POINT is not a party to any offline arrangements made through our Platform and does not organize, operate, supervise, or control events or interactions between users. POINT does not conduct background checks on members and does not attempt to verify the truth or accuracy of statements made by members. Where an organization requires a background check, it is performed by Checkr or another third-party provider under an agreement between that provider and the organization, and POINT receives only the status of the check, as described in Section 6.e. POINT makes no representations or warranties concerning the conduct or Content of any members or their interactions with you.

e. No Resale

Our Platform contains proprietary and confidential information and is protected by intellectual property laws. You may in no way, willfully or by accident, alter or otherwise modify, reproduce, sell or charge a fee, offer to sell or charge a fee, make, create derivative works based on, or distribute any part of our Platform, including any data, or Content of others, except as expressly authorized by POINT in writing, including through the Syndication Services.

f. No Technical Interference with the Platform

You agree that you will not engage in any activity or post any information or material that interferes with or disrupts, or that is designed to interfere with or disrupt, the Platform or any hardware used in connection with the Platform.

g. Platform Modifications

We may modify or discontinue portions or all of our Platform with or without notice and without liability to you or any third party.

h. Third Party Sites and Services

The Platform may contain links to third party sites and is integrated with various third party services, applications, and sites that may make available to you their content and products. We do not control these third parties and are not responsible for those sites or services or their content or products. These third parties may have their own terms and policies, and your use of them will be governed by those terms and policies.

i. Intended Use for Organizers

Organizations and individuals acting as organizers, event leaders, or administrators agree that they are using the Platform solely to mobilize, coordinate, and manage volunteers for charitable, nonprofit, or community-focused activities. Organizers agree not to use the Platform for purposes unrelated to community service, including but not limited to commercial solicitation, support of political campaigns, political candidates, or legislative purposes or any activity that is inconsistent with the mission of POINT or the expectations of volunteers using the Platform. POINT reserves the right to suspend or terminate organizers and organization accounts that, in its reasonable discretion, use the Platform in a manner inconsistent with this intended use.

8. Release, Indemnification, Liability and Warranty

a. Summary

POINT is not responsible for any losses incurred through the use of the Platform, and you release us from financial responsibility from any lawsuits arising from your use of the Platform.

b. Release

You hereby agree that all POINT officers, agents, employees, parents, affiliates and successors are not liable for any loss, be it personal or monetary, or any damages without limitation, including personal injury, property damage or death that is either directly or indirectly related to any event posted on the POINT app or any interaction affiliated with or arising from your use of the Services.

c. Indemnification

You agree to indemnify, defend and hold all POINT affiliates harmless from any Claims, made by any and all third parties due to or arising from (a) your violations of this Agreement, (b) your use, misuse, or abuse of our Platforms, (c) your Content or any Content you interact with, (d) your violation of any law, statute, ordinance or regulation or the rights of a third party, or (e) your participation or behavior in a POINT event that violates this Agreement. You agree to promptly notify us of any third party Claims, and cooperate with all POINT Parties in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys’ fees). You agree not to settle any Claim without our prior written consent.

d. Limitation of Liability

You agree that in no event shall any POINT Parties be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to, damages for loss whether it be tangible, intangible, monetary, or personal (even if any POINT Parties have been advised of the possibility of such damages) arising out of or in connection with (a) our Platforms or this Agreement or the inability to use our Platforms (however arising, including our negligence), (b) statements or conduct of or transactions with any member or third party on the Platforms, (c) your use of our Platforms or transportation to or from POINT events, attendance and participation or exclusion from events, actions of any person or entity at the event, or (d) any other matter relating to the Platform. Nothing in this Section excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or willful injury. Subject to the preceding sentence, the total aggregate liability of the POINT Parties arising out of or relating to these Terms or the Platform will not exceed the greater of (i) the total fees you paid to POINT in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100).

e. Warranty

Our Platforms are provided to you “as is” and on an “as available” basis. We disclaim all warranties of any kind, including but not limited to statutory, implied, non-infringement warranties and conditions of any kind. We also disclaim any warranties regarding (a) the reliability, timeliness, accuracy, and performance of our Platform, (b) any information, advice, services, or goods obtained through or advertised on our Platform or by us, as well as for any information or advice received through any links to other websites or resources provided through our Platform, (c) the results that may be obtained from the Platform, and (d) the correction of any errors in the Platform, (e) any material or data obtained through the use of our Platform, and (f) dealings with or as the result of the presence of marketing partners or other third parties on or located through our Platform.

9. Disputes

a. Dispute Resolution

By using the Platform, you agree that these Terms of Use and your use of the Platforms shall be governed by and construed in accordance with the laws of the State of Ohio in the United States, without regard to any choice of law provisions. You agree to submit to personal jurisdiction in the State of Ohio and further agree that any cause of action arising from or relating to the use of the Platforms or these Terms of Use shall be brought exclusively in the Federal or State Courts residing in Ohio.

b. Failure to Enforce

Company’s failure to enforce or exercise all or any of the rights or provisions of the Terms of Use shall not constitute a waiver of such rights or provisions.

c. Rights That Cannot Be Waived

Nothing in these Terms limits or waives any right you have that cannot be limited or waived under the law of your state of residence, and nothing in this Section prevents you from bringing a claim in any forum in which applicable law gives you a non-waivable right to do so.

10. Ownership, Copyright and Intellectual Property

a. Copyright

All POINT images, logos, content, software, and names are the intellectual property of POINT. You may not duplicate, copy or reuse any visual elements, or any portion of the HTML, CSS, JavaScript or other code without the express written consent of POINT.

b. Intellectual Property

Do not use any intellectual property of or pertaining to POINT or our Platforms without express written permission. While using our Platforms, ensure that all Content posted is your own and/or you have the rights to it, and do not infringe on the intellectual property of others. Any Content that we believe may be infringing on the property of other users or entities may be removed without notice and we may suspend the user’s account. If you believe your intellectual property rights have been violated, please inform our team immediately.

c. Reproduction

You are not permitted to reproduce, duplicate, copy, sell, resell, exploit or use for your own profit any portion of the Platform without the express written consent of POINT. You may not modify, adapt or hack the Platform. The modification of another website so as to falsely represent association with the Platform or Company is strictly prohibited.

11. Miscellaneous

This Agreement and the relationship between you and POINT shall be governed by the laws of the State of Ohio without regard to its conflict of laws provisions, except as set forth in Section 9. This entire agreement between you and POINT consists of this Agreement of Terms and Conditions, the Privacy Policy, the Authorized Use Policy, the Community Guidelines, the Cancellation and No-Show Policy, and the AI Features Terms of Use. You may not assign or transfer these Terms, in whole or in part, without POINT’s prior written consent, and any attempted assignment without such consent is void. POINT may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, and these Terms will bind and benefit each party’s permitted successors and assigns. If any provision of this Agreement is found to be invalid by a court of competent jurisdiction, you and POINT nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and that the other provisions of this Agreement will remain in full force and effect.

Authorized Use Policy

This POINT Authorized Use Policy (“AUP”) establishes rules for acceptable use of POINT’s Platforms. It supplements and is incorporated into POINT’s Terms of Use.

This AUP applies to anyone who accesses or uses the Platforms, including individuals and organizations.

1. Agreement

This AUP governs all use of the Platforms and is incorporated into POINT’s Terms of Use. It applies to you, to any organization on whose behalf you use the Platforms, and to all Content submitted to the Platforms.

By using the Platforms, you agree to comply with this AUP. If you are using the Platforms for an organization, you agree to comply with this AUP on the organization’s behalf.

Capitalized terms not defined here have the meanings given in the Terms of Use.

2. Definitions

For purposes of this AUP:

a. “POINT,” “Company,” “we,” “us,” and “our” mean POINT Technologies, LLC, an Ohio limited liability company.
b. “Platform” or “Platforms” means any website, widget, application, dashboard, kiosk, feed, or service offered by POINT, including Content we offer and electronic communications we send.
c. “You,” “your,” “user,” “volunteer,” and “member” mean any person using our Platform. “Organizers,” “companies,” “schools,” “event sponsors,” “event organizers,” “organization administrators,” “volunteer administrators,” “event leaders,” “nonprofit administrators,” and “nonprofit organizers” mean any organization or person using the Platform on an organization’s behalf. Organizations may include nonprofits, schools, universities, community organizations, local governments, and companies.
d. “Syndication Services” has the meaning given in the Terms of Use.

3. Revisions

We may update and change this AUP from time to time.

If we make a material change, we will provide notice by posting the updated AUP on the Platform with a revised “Last Updated” date and, where we have your email address, by email or through the Platform.

Continued use of the Platform after any such change constitutes consent to and acceptance of the updated AUP.

4. Authorized Use

By using the Platform, you agree to:

comply with POINT’s Terms of Use, Privacy Policy, and Community Guidelines;
comply with applicable laws, rules, and regulations, including applicable intellectual property, data, privacy, and export control laws;
handle data and information you access through the Platform responsibly, only for purposes you are authorized to use it for, and in accordance with applicable privacy and data protection laws;
take reasonable steps to prevent unauthorized access to your account and the Platform; and
comply with any Compliance Criteria or other requirements that apply to your organization or account.

Organizations must agree to use the Platform for community impact purposes and not primarily for commercial promotion, marketing unrelated to volunteer service, membership recruitment, support of political campaigns or political candidates, or legislative purposes, as further described in the Compliance Criteria presented during account creation.

Opportunities may not be used to recruit unpaid workers for ordinary business operations, commercial activities, or other purposes that do not constitute legitimate charitable, nonprofit, or community-focused volunteer service. Organizations are responsible for ensuring that volunteer opportunities comply with applicable labor and employment laws.

Faith-based organizations may use Public Opportunities for charitable, nonprofit, and community-focused volunteer opportunities. Public Opportunities may not be used primarily for proselytizing or religious conversion. This restriction does not apply to Private Opportunities.

Content you share or upload through the Platform must respect the rights of others and may not infringe any copyright, trademark, privacy right, or other intellectual property or legal right.

5. Prohibited Activities

You may not use the Platform to:

distribute viruses, malicious software, or other harmful code;
gain or attempt to gain unauthorized access to the Platform, another user’s account, or systems or networks connected to the Platform;
bypass, disable, circumvent, or interfere with security measures or other technical restrictions;
interfere with or compromise the security, performance, operation, or integrity of the Platform;
engage in spoofing, phishing, or other deceptive or fraudulent activity;
impersonate another person or organization, including a POINT employee, administrator, owner, or other user, or falsely represent your identity or affiliation;
check in for anyone other than yourself, ask someone else to check in for you, or falsify attendance or volunteer hour records;
reverse engineer, copy, reproduce, or attempt to build a competing service based on the Platform, except as expressly authorized by POINT in writing;
create accounts in bulk through unauthorized or automated means;
scrape, harvest, or collect data from the Platform through unauthorized means, except through the Syndication Services or as expressly authorized by POINT in writing;
use the Platform to distribute unsolicited promotional or advertising material;
use the Platform to incite or promote violence, unlawful discrimination, hatred, harassment, abuse, or other harmful conduct; or
use the Platform in any way that violates applicable law, this AUP, the Terms of Use, the Community Guidelines, or another applicable POINT policy.

Nothing in this Section prohibits an organization, partner, or other authorized party from using POINT’s Syndication Services, APIs, feeds, or other services in a manner expressly authorized by POINT.

6. Your Responsibilities

You are responsible for maintaining the confidentiality and security of your account information, including your username and password. You may not share your personal login or provide another person with access to your account.

You are responsible for activity that occurs through your account and for complying with this AUP.

If you know or suspect that someone has gained unauthorized access to your account or that your account or the Platform is being misused, notify POINT promptly at support@pointapp.org.

7. Compliance with Laws

You may not use the Platform in any way that violates applicable federal, state, local, or international laws, rules, or regulations.

You are responsible for complying with laws that apply to your use of the Platform, your Content, and your activities.

8. Consequences of Violations

POINT may investigate suspected violations of this AUP, including by reviewing relevant Content, account activity, or other information as reasonably necessary to investigate or address a suspected violation.

POINT may remove or restrict access to Content or take other appropriate action if we reasonably believe that Content or activity violates this AUP, the Terms of Use, the Community Guidelines, applicable law, or the rights or safety of another person.

We may modify, restrict, suspend, or terminate your account or access to the Platform for violations of this AUP in accordance with the Terms of Use.

Where appropriate or required by law, POINT may report suspected illegal activity or cooperate with law enforcement.

Community Guidelines

POINT is the starting point to volunteer and helps local nonprofits find help faster.

As members of this community, we all have a responsibility to be genuine, responsible, and respectful. These Guidelines explain the behavior and content we expect from everyone who uses POINT.

POINT Technologies, LLC (“POINT”) reserves the right to interpret and enforce these Guidelines. Content that violates these Guidelines may be removed, and violations may result in restrictions, suspension, or termination of your access to POINT in accordance with our Terms of Use.

1. Agreement

These Guidelines are incorporated into and form part of our Terms of Use. They apply to you and to any organization on whose behalf you use POINT.

These Guidelines work alongside our Authorized Use Policy and Privacy Policy and do not replace them.

4. Be Yourself

Your POINT profile should genuinely represent you or your organization. Fake accounts, impersonation, or profiles created to troll, deceive, or annoy others are not allowed. Do not share another person’s private information without their permission.

Being yourself doesn’t stop at your profile. When you sign up for an opportunity, you are the person the organization is expecting. Show up as yourself and check in only for yourself.

Do not check in on someone else’s behalf, ask someone to check in for you, or record hours you did not serve. Nonprofits, schools, employers, and other organizations rely on POINT’s attendance and hour records, and organizations may screen volunteers for specific roles. Standing in for someone else undermines the accuracy and integrity of those records.

5. Be Respectful

If you sign up for a volunteer opportunity, make it a priority to attend. We understand that plans change, but repeated or habitual no-shows may result in restrictions on your account or access to POINT.

Do not intentionally deceive, undermine, harass, or harm organizations, volunteers, staff, or the people an organization serves. Respect personal boundaries and the people you interact with through POINT.

6. Be Accurate

Accuracy builds trust. Users must provide accurate and truthful information in their profiles, forms, registrations, and other Content they submit through POINT.

Organizations must also provide accurate and truthful information when creating or managing Content on POINT. Event and opportunity listings should include clear and accurate information about what volunteers can expect. While details may change, updates should not materially change the original purpose, nature, or expectations of the opportunity.

7. Be Nice

A respectful and kind community is a thriving one.

Harassment, bullying, exploitation, threats, hateful conduct, or behavior intended to physically, emotionally, or mentally harm another person will not be tolerated.

Treat other volunteers, organization staff, POINT personnel, and the people organizations serve with respect.

8. Be Safe

Safety first. Prioritize your safety and the safety of others. Follow applicable laws and avoid actions that could put you or someone else at risk.

These Guidelines apply to your conduct at volunteer events, not just what you post on POINT. Volunteering often happens in person, and your conduct at an opportunity you found through POINT, including your conduct toward staff, other volunteers, or the people an organization serves, may affect your access to POINT.

If you believe you or someone else is in immediate danger, contact local emergency services right away.

9. Look Out for Younger Volunteers

Volunteers on POINT can be as young as 13, and some opportunities bring adults and minors together.

Organizations set their own age requirements, supervision requirements, and safeguarding rules for their opportunities. Volunteers are expected to follow those requirements.

Adults volunteering alongside minors must keep interactions appropriate, respect personal boundaries, follow the organization’s supervision and safeguarding requirements, and keep interactions within the scope of the volunteer activity. Do not seek out a minor’s personal contact information or use your connection through POINT to arrange contact or meetings outside the volunteer activity.

10. Protect Your Information

Be thoughtful about the personal information you share through POINT.

When you register for an opportunity, certain information about you is shared with the hosting organization so it can manage your participation. Our Privacy Policy explains what information we collect, how we use it, and when it may be shared.

Do not share another person’s personal or private information without permission.

11. Keep It G

POINT is a platform for people of different ages and backgrounds. Keep publicly shared Content appropriate for a general audience.

Do not post pornography, nudity, sexually explicit or sexually suggestive Content, Content with sexual undertones, graphic violence, or other obscene or seriously disturbing Content.

Content may be removed when we reasonably determine that it is inappropriate for the POINT community or violates these Guidelines.

12. Respect Intellectual Property

Creativity deserves respect. Do not post Content that infringes another person’s or organization’s copyrights, trademarks, or other intellectual property rights. Only share Content that you own or have the right to use.

13. Use POINT for Its Intended Purpose

Use POINT for its intended purpose of supporting charitable, nonprofit, and community-focused volunteer activities.

Our Authorized Use Policy contains additional rules about acceptable use of POINT, including restrictions on unauthorized access, technical interference, scraping, spam, falsifying volunteer records, and other misuse of the Platform.

Organizations and users are responsible for complying with the Authorized Use Policy when using POINT.

14. Report a Concern

If you see something that doesn’t belong on POINT, including a fake profile, a listing that isn’t what it claims to be, misuse of the Platform, or behavior that made you or someone else uncomfortable, contact us at support@pointapp.org.

If the concern involves an immediate threat or danger, contact local emergency services first.

If you believe POINT restricted, suspended, or terminated your account in error, contact us at support@pointapp.org and we’ll review your concern.

AI Features Terms of Use

These POINT AI Features Terms of Use (“AI Terms”) supplement and are governed by POINT’s Terms of Use, Privacy Policy, and any other applicable agreements between you and POINT (collectively, the “Agreement”). In the event of a conflict, these AI Terms govern solely with respect to the AI Features.

These AI Terms apply only to the use of optional artificial intelligence tools and functionality made available by POINT that you or your organization explicitly choose to enable or use (“AI Features”). The AI Features are optional and may be disabled by an organization at any time.

1. Agreement

These AI Terms are entered into between POINT Technologies, LLC (“POINT”) and you. They govern your access to and use of the AI Features, are incorporated into the Terms of Use, and supplement it. By enabling or using any AI Feature, you agree to these AI Terms and the Agreement. If you do not agree, do not enable or use the AI Features.

Capitalized terms not defined here have the meanings given in the Terms of Use.

2. Definitions

For purposes of these AI Terms:

a. “POINT,” “we,” “us,” and “our” mean POINT Technologies, LLC, an Ohio limited liability company.
b. “You” and “your” mean the individual accessing or using the AI Features and, where applicable, the organization on whose behalf that individual accesses or uses the AI Features.
c. “AI Features” means the optional artificial intelligence tools and functionality made available by POINT that you or your organization explicitly choose to enable or use.
d. “Third-Party AI Services” means artificial intelligence services provided by third parties that POINT uses to deliver the AI Features.
e. “Customer Data” means content or data submitted to or through the Platform by you or your organization.

3. Revisions

POINT may update these AI Terms from time to time, including to reflect changes in the Third-Party AI Services we use. When a significant change is made, users will be notified via email or through notifications within the Platform, and the updated AI Terms will be posted with a revised “Last Updated” date. Continued use of the AI Features after any update constitutes acceptance of the revised AI Terms. Questions about these AI Terms may be sent to support@pointapp.org.

4. Opt-In Use of AI Features

Use of AI Features is entirely optional. Organizations, administrators, and users are not required to use AI Features in order to access or use the POINT Platform.

Organizations may disable AI Features at any time. Disabling AI Features will prevent any further use of AI functionality for that organization.

5. Purpose and Intended Use

The AI Features are intended solely to assist organizations and users with tasks such as drafting, summarizing, organizing, categorizing, or analyzing information related to charitable, nonprofit, or community-focused activities on the Platform.

AI Features are provided as a support tool only and are not intended to replace your own judgment, review, or decision making. You are responsible for reviewing AI-generated Content before using or relying on it.

6. Use of Third-Party AI Services

The AI Features incorporate artificial intelligence services provided by third-party providers (“Third-Party AI Services”), which may include providers such as Amazon Web Services or Google.

Use of the AI Features is subject to the applicable enterprise terms, privacy commitments, and data protection practices of these Third-Party AI Services. When a Third-Party AI Service is used to provide an AI Feature, certain Customer Data may be sent to and processed by that provider as necessary to provide the feature. POINT selects Third-Party AI Services based in part on their privacy, security, and data protection practices. Customer Data processed in connection with AI Features is also subject to our Privacy Policy.

7. Customer Data and AI Processing

a. Limited Use of Data

POINT may send Customer Data to a Third-Party AI Service when necessary to provide an AI Feature you choose to use. We seek to limit the Customer Data sent to a Third-Party AI Service to the information reasonably necessary to provide the applicable AI Feature.

b. No Training on Customer Data

Neither POINT nor any Third-Party AI Service uses Customer Data to train machine learning models. Customer Data submitted in connection with AI Features is not retained beyond the processing session except as required to provide the requested functionality or as otherwise permitted under the Agreement.

c. Privacy and Security

Customer Data processed in connection with AI Features is protected in accordance with POINT’s Privacy Policy, the Agreement, and the applicable privacy and security terms of the Third-Party AI Services. You should not submit sensitive personal information to an AI Feature unless the information is reasonably necessary for the intended use of that feature and you are authorized to provide it.

You are responsible for the Content and information you choose to submit to AI Features.

8. Responsibility for Inputs and Outputs

You are solely responsible for:

Reviewing, verifying, and approving any outputs generated by AI Features before use

AI-generated outputs may be inaccurate, incomplete, or inappropriate for certain uses. You agree not to rely on AI outputs without independent review and judgment.

9. Restrictions on Use

You agree not to use AI Features for outside of their intended purposes as described in Section 5 and not use AI features to generate or assist with content that is:

Illegal or deceptive
Harmful, abusive, or defamatory
Infringing on intellectual property or privacy rights
Inconsistent with POINT’s mission, Community Guidelines, or applicable laws

You also agree not to misuse, circumvent, interfere with, or attempt to gain unauthorized access to AI Features or their underlying systems.

You may not use AI Features as the sole basis for a decision that determines a person’s eligibility, access, rights, or opportunities where that decision could have a legal or similarly significant effect.

POINT reserves the right to suspend or terminate access to AI Features if it reasonably believes they are being used in violation of these AI Terms or the Agreement.

10. Disclaimers

a. No Responsibility for Outputs

POINT is not responsible or liable for any outputs generated by AI Features or for how such outputs are used. All outputs are provided for informational or assistive purposes only. The warranty disclaimers, releases, limitations of liability, and other protections contained in the Terms of Use also apply to your use of AI Features.

b. As-Is

AI Features are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose.

11. Changes to AI Features or Terms

POINT may modify, update, or discontinue AI Features at any time and without liability to you or any third party.

12. Relationship to Main Terms

These AI Terms apply only to the use of AI Features and do not alter or expand POINT’s rights to use content or data outside the scope described herein. All other uses of the Platform remain governed by the main Terms of Use and Privacy Policy. Content that you create or edit with the assistance of AI Features and post to the Platform is your Content for purposes of the Terms of Use and is subject to the license and distribution provisions of those Terms, including the Syndication Services.
